You should speak to an attorney before talking with any insurance company. Reputable attorneys offer a free consultation to allow for an evaluation of your case.

Before the Appointment

Speaking to an attorney may feel intimidating, but it is important to remember that your lawyer is on your side. Write down a list of your main concerns so you will not forget anything you want to want to inquire about. 

Compile notes and details and keep a diary about your case so you can go over them with your attorney. This will help them give you a realistic assessment about what you can expect.

Questions to Ask a Personal Injury Attorney

Initial consultations are the best time to ask the questions that will help you make a decision about a personal injury lawyer. You will want to know about their background, their qualifications, how they manage cases, and how payment works, as well as what they think of your case.

  • Background Questions – How long have you practiced law? Do you only practice personal injury law, or do you take other kinds of cases? How many personal injury cases do you take each year? Make sure your attorney has handled thousands of cases like yours, and has been in business for at least 20 years. 
  • Case Management Style – Are you my everyday contact? How often can I expect progress reports from you? Do you handle court appearances and negotiations? What will my role be?
  • Fees and Payments – Do you have a contingency fee? Do you charge an hourly rate? Are there retainer fees for hiring you? Will I have to pay other expenses, and what is your estimate of those fees? Do I have to pay you if we do not win a settlement? Will I be responsible for case-related costs if I don’t win? 
  • Your Case – What is your assessment of my situation? What factors will work in favor of this case? What factors will work against it? Do you believe we will need to go to trial? Is mediation or arbitration an option? How long do you believe this case will take? What is my case worth? Remember that some things, such as case value, depend upon the injuries and treatment, so the attorney can only evaluate the case value at a later date.
